How i seriously met this situation is the time i created a custom work from a skin from skin directory -instead of starting from scratch- presuming it was already validated and proper .. But it has been a total failure as the skin had important validation errors by default.. (no i am not gonna mention which it is)..
These errors sometimes -as in my case- cause really serious displaying faults , esp. in IE..
Just to give you an idea what is going on; here are the results for the latest 10 skins submitted to skins index:

should be added to these with a record high validation error : P.. just to mention for those using it, it has serious sidebar problems..

Bottomline is; afaiconcern the skins that dont validate should be kindly returned to the author for further review, just because b2 does not have much skins, it does not mean all the skins should be accepted, and i am also against manipulating a skin very little (like colors only) and re-releasing it.. Of course these are only ideas of mine.
Personally I think valid xhtml and css should be The Law.
Way back in the day I worked my butt off to upgrade all the 0.* skins for 1.* - including making them all validate properly. Because like you say: crappy skins make for lots of problems in certain low-end browsers. BTW even a valid skin can have display issues in IE, but that is clearly an IE problem.
